Terms and Conditions of Business
At Bradgate Flowers, we take great pride in the quality of our flowers and service. If for any reason you are not satisfied with your order upon delivery, we request that you contact us immediately on 07561 175705
We will carefully review any concerns raised and, where the issue is found to be within our reasonable control, we may offer a replacement, re-delivery, full refund, or partial refund as appropriate.
As we work with perishable although fresh seasonal flowers, availability can occasionally be affected by weather conditions, supplier availability, and seasonal variations. In such circumstances, we reserve the right to substitute flowers or materials with suitable alternatives of equal or greater value while maintaining the overall style, colour palette, size, and quality of the arrangement.
In the unlikely event your order arrives damaged, we will offer either a replacement or a full refund.
If delivery is made later than the agreed delivery date due to circumstances within our control, we may refund the delivery charge associated with the order.
Where delivery cannot be completed because the recipient is unavailable, we will make reasonable attempts to contact the recipient using the details provided. If unsuccessful, a calling card or delivery notification may be left with instructions for arranging re-delivery.
Following two unsuccessful delivery attempts, we regret that we cannot offer a refund or complimentary re-delivery.
1. Products
1.1 All products and services offered through this website are available for delivery within the United Kingdom only, subject to our delivery areas and availability.
1.2 Certain flowers may be delivered in bud form to maximise vase life and ensure the longevity of the arrangement.
1.3 Some flowers and plants may be harmful or poisonous if ingested. If you require further information before placing an order, please contact us using the details provided in Section 5 and above.
1.4 All products are subject to availability. In the event of supply difficulties, we reserve the right to substitute flowers or products with alternatives of equal or greater value whilst maintaining the overall style and quality of the arrangement.
1.5 If we are unable to supply the ordered product or a suitable substitute, we will notify you as soon as reasonably practicable and provide a full refund of any monies paid.
2. Prices
2.1 All prices displayed are in Pounds Sterling (£) and include VAT where applicable.
2.2 Prices displayed at the time of ordering are valid for that transaction only.
2.3 We reserve the right to amend prices without prior notice.
3. Orders
3.1 When placing an order, you will be required to provide accurate personal details, recipient details and payment information.
3.2 Payment may be made using most major debit and credit cards, We do not accept American Express.
3.3 Submission of an order constitutes an offer to purchase products from Bradgate Flowers.
3.4 A contract shall only be formed once we have accepted your order and issued an order confirmation.
3.5 We reserve the right to refuse any order at our discretion.
3.6 Orders may only be placed by persons aged 18 years or over.
4. Delivery
4.1 Our personal delivery service is available within our designated delivery areas.
4.2 Our official working days are Monday to Friday and exclude any public UK holidays
4.3 Orders received on Saturday, Sundays or Public Holidays will be processed on the next working day and delivered the following day.
(For any orders received Saturday, sunday or public holiday - order processed Monday, delivered earliest Tuesday)
4.3.1 Orders received after 12 noon on a Friday will be processed on the next working day and delivered the following day.
(For any orders received after 12 noon on a Friday - order processed Monday, delivered earliest Tuesday)
4.4 We do not deliver on Sundays or Public Holidays unless specifically agreed, an additional fee may be payable.
4.5 Customers are responsible for ensuring all delivery details, including postcode and recipient information are accurate.
4.6 Whilst every effort will be made to deliver on the requested date, delivery times cannot be guaranteed.
4.7 Where delivery is made to hospitals, offices, hotels, care homes, funeral directors or similar establishments, acceptance by authorised personnel shall constitute proof of delivery.
4.8 If no one is available to receive the order, we may leave it with a neighbour, in a safe place, or leave instructions for re-delivery where appropriate. we never under any circumstances leave deliveries on doorsteps unless it is explicitly safe to do so.
4.9 Whilst delivery time preferences will be considered, they cannot be guaranteed except where specifically agreed in writing.
4.10 Should delivery difficulties arise, we reserve the right to contact either the sender or recipient using the details provided.
4.11 Any delivery instructions supplied must be reasonable, lawful and safe. We reserve the right not to follow instructions deemed unsuitable or unsafe.
5. Cancellation, Amendments & Refunds
5.1 General Flower Orders
Due to the perishable nature of flowers and plants, all orders become binding once payment has been received and order confirmation has been issued.
In accordance with Regulation 28 of the Consumer Contracts Regulations 2013, fresh flowers and plants are exempt from standard cancellation rights.
Once confirmed, orders cannot be cancelled, amended or refunded. Requests for amendments may be considered at our discretion but cannot be guaranteed.
5.2 Same-Day and Next-Day Delivery Orders - should not be placed before contacting us directly by phone on 07561 175705
Orders placed for same-day or next-day delivery are processed immediately and cannot be cancelled, amended or refunded once submitted. An additional fee may be charged.
5.3 Funeral and Sympathy Tributes
Funeral flower orders require advance purchasing and preparation of specific flowers and materials.
Once confirmed, funeral orders cannot be cancelled or refunded.
Requests for amendments may only be accommodated where flowers have not already been purchased and production has not commenced.
Suitable substitutions may be made where necessary whilst preserving the intended style and sentiment of the tribute.
5.4 Wedding and Event Floral Services - A wedding or event booking is secured upon receipt of two elements:

A non-refundable Save the Date Fee; and
-
A booking deposit equal to 25% of the estimated net order value.
The Save the Date Fee becomes non-refundable after the statutory 14-day cooling-off period.
The booking deposit is non-refundable where consultation, planning, design work, flower sourcing or other work has commenced.
Once a booking is confirmed, Bradgate Flowers reserves production capacity, allocates resources and begins planning and sourcing specifically for your event.
Cancellation charges are as follows:

Save the Date Fee – Non-refundable after cooling off period ( 14 days from the date the payment was received electronically by Bradgate Flowers)

Deposit – Non-refundable where work has commenced.

Cancellation within 12 weeks of the event date – 75% of the net total confirmed booking value payable.

Cancellation within 6 weeks of the event date – 100% of the total confirmed booking value payable.Any monies already paid will be deducted from the outstanding balance due.

Requests to change the event date may be accommodated subject to availability and may incur additional costs.
5.5 Payments All deposits for weddings and events shall be made by BACS (Electronic bank to bank clearing service)
5.6 Wedding Cancellation Insurance - We strongly recommend that clients obtain wedding or event cancellation insurance to protect against unforeseen circumstances.
5.7 Fraudulent Payments - You are entitled to cancel any payment where fraudulent use of your payment card has occurred without your authority, subject to verification.
5.8 Complaints - Any complaint regarding the quality, condition or delivery of flowers must be made within one working day of delivery.
Photographic evidence may be requested.
Corporate and Business Orders
5.9 Business, Corporate and Account Customers
Orders placed by business customers are binding once confirmed. As flowers and materials are purchased specifically to fulfil each order, cancellations will not be accepted once processing has commenced.
Contracted regular flower deliveries may only be cancelled in accordance with the terms of the relevant service agreement.
5.91 Custom and Bespoke Designs
Bespoke Floral Arrangements
Custom-designed arrangements, installations, and special commissions are created specifically to customer requirements. Once an order has been confirmed, no cancellation, return, or refund will be accepted unless the product is faulty or not supplied as agreed.
6. General
6.1 We reserve the right to amend these Terms and Conditions at any time. Updated versions will be published on our website.
6.2 We reserve the right to suspend, restrict or terminate access to our website or services at our discretion.
6.3 If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall remain in force.
6.4 We will process personal information in accordance with applicable UK Data Protection legislation and our Privacy Policy.
6.5 Nothing in these Terms and Conditions shall affect your statutory rights.
6.6 A person who is not a party to this agreement shall have no rights under the Contracts (Rights of Third Parties) Act 1999.
6.7 These Terms and Conditions constitute the entire agreement between the parties and supersede all prior agreements and understandings.
6.8 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
6.9 The parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.
Consumer Rights - Statutory Rights
Under Regulation 28 of the Consumer Contracts Regulations 2013, customers do not generally have a right to cancel contracts for the supply of goods liable to deteriorate or expire rapidly, including fresh flowers and plants.
Nothing in these terms affects your statutory rights. If products are delivered damaged, defective, or not as described, please notify us within 24 hours of delivery and provide photographic evidence where possible so that we can investigate and offer an appropriate remedy.
